1. The agreement
These terms are between you (the account holder) and Psychemeta Ltd (trading as Hospitality App), a company registered in England & Wales. Using the service means you accept them.
2. Your account
You're responsible for keeping your sign-in credentials secure and for the actions of anyone you invite. Don't share your password. If you suspect a breach, change your password and email security@hospitalityapp.co.uk.
3. Acceptable use
- Don't use the service to break UK law, including employment, food-safety and licensing regulations.
- Don't reverse-engineer the service or attempt to access another business's data.
- Don't upload malware, illegal content, or material you don't have rights to.
- Don't run penetration tests or load-test against production without written permission.
4. Your data, your rights
You own everything you put into the service. We get a limited licence to host, back up and display it so the service works. You can export it any time. See the Privacy Policy for the data-protection specifics.
5. Our IP
The software, brand, copy and design are ours. You're getting a non-exclusive licence to use it for the duration of your subscription. Nothing here transfers ownership.
6. Fees
- Prices are shown on the pricing page, exclusive of VAT.
- There is no minimum term on a monthly plan. Monthly subscriptions run month to month and auto-renew monthly unless cancelled before the renewal date. There is no commitment period, no notice period and no exit or early-termination fee.
- There is no setup fee, onboarding fee or installation charge.
- Per venue, not per device. Your subscription covers the venue. Adding a till, a kitchen display or a handheld does not add a licence fee.
- Annual plans are different, and you should know which you are on. An annual plan is twelve months paid in advance in exchange for two months' discount. It is a twelve-month commitment: annual plans are non-refundable except where required by law. If you want the freedom to leave at any point, choose monthly.
- Cancelling a monthly plan stops the next renewal. Your subscription runs to the end of the period you have already paid for, and you keep full access until then. Refunds of part-months on cancellation are at our discretion.
- We can change prices with 30 days' notice; you can cancel within that window without penalty.
- You can cancel yourself, at any time, in a couple of clicks. The billing screen in the app opens your customer portal, where cancellation is available directly. You do not need to phone us, email us or give notice in writing. Cancellation takes effect at the end of the period you have already paid for — you are not cut off mid-period. If you would rather we did it for you, email hello@hospitalityapp.co.uk and we will action it.
7. Service levels
We aim for 99.5% monthly uptime on Essentials, Professional, Complete and Complete Plus. Multi-venue customers on the group discount (5+ venues) get 99.9% uptime targets and a written SLA. Scheduled maintenance is announced in advance and excluded from uptime calculations.
8. Termination
You can cancel yourself at any time from the in-app billing screen, with no notice period and nothing further to pay — see section 6. We can suspend or terminate access if you breach these terms (after notice and a chance to fix it, except for serious breaches). On termination we keep your data for 30 days, then delete it — see the Privacy Policy.
9. Liability
We provide the service "as is". Our total aggregate liability to you in any 12-month period is capped at the fees you've paid in that period. We're not liable for indirect or consequential losses, lost profits, lost goodwill or lost data beyond what's recoverable from the most recent backup. Nothing in these terms excludes liability we can't legally exclude (e.g. fraud, death or personal injury caused by negligence).
10. Indemnity
You'll defend us against claims that arise because you misused the service, broke the law, or uploaded content you didn't have rights to.
11. Changes
If we change these terms materially we'll email account-holders. Continued use after the change means you accept the new terms.
12. Governing law
These terms are governed by the laws of England & Wales. Any dispute that can't be resolved by agreement goes to the exclusive jurisdiction of the English courts.
